Very often, you'll find that once you've gotten one call, you'll start getting a lot more of them, because the list with your phone number on it has likely been sold to multiple telemarketing companies. Many times, the calls can be from "spoofed" numbers. As soon as they hear your voice, they start with the pitch. When someone answers the call, a transfer to a live operator either happens automatically, or because you're instructed to "press 1". The telemarketer sits in a cubicle in a "boiler room" style somewhere, usually in another state. Those lists are then sold to telemarketing companies who program the numbers into telephone systems that automatically dial those numbers over and over again. It all starts with marketers, who create lists of cell phone numbers pulled from any number of online sources. In the event that the existence of such consent is argued, courts have found that the burden of proving consent lies with the caller, and not with the consumer. Additionally, that consent can be revoked at any time. In order for a telemarketer to call you, they must have express, prior, written consent, in clear, unambiguous wording that the cell phone can be called with recorded messages. That law was called The Telephone Consumer Protection Act, or TCPA. They also included a blurb about cell phones, too, because back then, everyone paid for the minutes they used, and it wasn't fair to make people use their paid-for minutes to listen to unsolicited advertising calls. In 1991, a federal law was passed that made unsolicited advertisement faxes illegal, citing the fact that it wasn't fair to make consumers pay for an advertisement (paper/ink) that they never wanted, or asked for.
